  1. Once a person is convicted of a traffic violation and receives a fine, the court then notifies the Department of Motor Vehicles (DMV) who assesses points.
  2. Demerit points are assigned when you are convicted of a traffic violation. The demerit points remain valid for two years from the date you commit the offense. This time frame is not the number of years a conviction stays on your DMV record, which is violation-specific.
  3. Depending upon the seriousness of the violation, it can carry 3, 4 or 6 demerit points.
  4. If you are 18 years of age or older, DMV will require you to complete a driver improvement clinic if you accumulate 12 demerit points within 12 months or 18 points within 24 months. If you do not complete the clinic within 90 days, DMV will suspend your driving privilege.
  5. If you have a Virginia commercial drivers license (CDL), you can be disqualified from driving a commercial vehicle if convicted of certain violations or repeated violations.
